CALIFORNIA'S ASSEMBLY BILL (AB) 90, WHICH DESIGNATES A STATE-COUNTY PARTNERSHIP IN DEVELOPING AND FUNDING IMPROVEMENT PROGRAMS FOR LOCAL CRIMINAL JUSTICE SYSTEMS, IS DESCRIBED AND ITS IMPLICATIONS ARE DISCUSSED.
Abstract
AB 90, PASSED IN 1978, PROVIDES $55 MILLION IN STATE SUPPORT DURING 1978-79 TO LOCAL PROGRAMS CONCERNED WITH ESTABLISHING SENTENCING ALTERNATIVES FOR LESS SERIOUS OFFENDERS. THE BILL LISTS SEVEN KINDS OF ELIGIBLE PROGRAMS: (1) PROGRAMS OPERATING NONSECURE FACILITIES, SHELTERED CARE FACILITIES, CRISIS RESOLUTION HOMES, COUNSELING AND EDUCATION CENTERS, AND HOME SUPERVISION FOR JUVENILES; (2) PROGRAMS FOR STATUS OFFENDERS PREVIOUSLY PROVIDED FOR BY AB 3121; (3) PROGRAMS DESIGNED TO LOCAL JUSTICE SYSTEM OFFENDER-CENTERED SERVICES OFFERED BY PROBATION DEPARTMENTS, COUNTY AND CITY LAW ENFORCEMENT AGENCIES, COURTS, AND OTHER AGENCIES; (4) PROGRAMS ESTABLISHING AND MAINTAINING PUBLIC AND PRIVATE ADULT CORRECTIONAL PROGRAMS AND FACILITIES; (5) LOCAL CRIME AND DELINQUENCY PREVENTION PROGRAMS; (6) PROGRAMS PROVIDING PUBLIC EDUCATION AND INFORMATION REGARDING CRIME AND DELINQUENCY PREVENTION; AND (7) PROGRAMS ESTABLISHING AND MAINTAINING JUVENILE HOMES, RANCHES, CAMPS, FORESTRY CAMPS, SCHOOLS, DAY CARE CENTERS, AND GROUP HOMES FOR JUVENILE COURT WARDS. ADVISORY GROUPS ARE APPOINTED BY COUNTY SUPERVISORY BOARDS TO ASSESS PROGRAM NEEDS AND MAKE RECOMMENDATIONS TO THE BOARDS WHICH IN TURN, SELECT PROGRAMS FOR FUNDING. THE BASIC FUNDING FORMULA MANDATED BY THE BILL IS DISCUSSED. PROGRAMS RECEIVING FUNDS WILL HAVE THEIR COMMITMENT LEVELS AND RESPONSIBILITIES MONITORED BY THE YOUTH AUTHORITY, THE STATE-LEVEL JUVENILE CORRECTIONS AGENCY. IT IS EXPECTED THAT AB 90 WILL MARK THE BEGINNING OF AN EFFECTIVE COUNTY JUSTICE SYSTEM. (DAG)
