Following an examination of the role of the prosecutor, the sources of ethical standards and their enforcement are discussed.
Abstract
Relevant caselaw and standards relating to prosecutorial responsibilities during the pretrial phase are reviewed, including those relating to investigation and discovery, charging, and plea negotiations. Additional standards and discussion focuses on prosecutorial relations with jurors, decorum in the courtroom, forensic irresponsibility, argument, and media relations. Emphasis is on providing prosecutors with guidance in developing a sense of professional responsibility in their management of whatever situations may arise in a case. Focus is on selected standards developed by the American Bar Association and the National District Attorneys Association. Such standards provide definition of the prosecutorial role both as a lawyer and as a public servant with a responsibility to serve the public interest, including that of those accused of crimes. Additional standards on discovery and media relations are provided. Chapter footnotes, table of cases cited, and 45-item bibliography.
