Extracts from the California Civil Code pertain to minors' consent for treatment, the emancipation of minors, and freedom from parental custody and control.
Abstract
Under conditions defined in these extracts, minors who have attained the age of 12 may receive outpatient mental health treatment or counseling without the consent of a parent or guardian. An "emancipated minor" is defined as any person under 18 years old who has entered into a valid marriage, is on active duty with the armed forces, or has received a declaration of emancipation pursuant to law. The extract lists the rights attending emancipation. In presenting the legal conditions for freedom from parental custody and control, the extracts indicate an action may be brought to have any child under the age of 18 years old declared free from the custody and control of either or both parents when the child meets any of the conditions described in the law. Provisions pertaining to the foster care of children are included.
