Corporate sentencing issues and the Federal Sentencing Guidelines are discussed.
Abstract
This issue contains seven articles addressing numerous issues regarding corporate criminal liability and the Federal Sentencing Guidelines (Guidelines). Included in the discussions are the Guidelines and publicly held and close corporations, the Sentencing Reform Act, innovative corporate sentences under the Guidelines, a proposed Model Federal Corporate Criminal Code, the advantages and disadvantages of implementing an effective compliance program, and a basic framework for establishing a compliance program to satisfy the Guidelines' requirements. Also included are four case comments analyzing United States v. Johnson, 964 F.2d 124 (2d Cir. 1992), Big Country Foods v. Board of Education, 952 F.2d 1173 (9th Cir. 1992), Westinghouse Electric Corp. v. Republic of the Philippines, 951 F.2d 1414 (3d Cir. 1991), and United States v. Harris, 959 F.2d 246 (D.C. Cir.), cert. denied, 113 S.Ct. 362 (1992).
