THIS ARTICLE DEALS WITH FACTORS THAT INFLUENCE THE DISPARITY OF SENTENCES AS SEEN WITHIN THE FUNCTIONING FRAMEWORK OF PUBLIC PROSECUTION AND THE JUDICIARY IN THE NETHERLANDS.
Abstract
THE AUTHOR EXPLAINS HOW SENTENCING TAKES PLACE IN EVERYDAY ADJUDICATION. HE THEN GOES BRIEFLY INTO THE LEGAL THEORIES AND PRINCIPLES THAT HAVE INFLUENCED SENTENCING. HE SURVEYS THE FACTORS THAT INFLUENCE SENTENCING, INCLUDING THE TYPE OF OFFENSE, THE CHARACTER OF THE OFFENDER, AND THE PROCEDURE INVOLVED IN SENTENCING. IN HIS CONCLUSION, THE AUTHOR DISCUSSES POSSIBLE WAYS OF HARMONIZING SENTENCING IN THE NETHERLANDS. --IN DUTCH...KAP
