This manual is designed to help practicing lawyers and judges to understand and apply the Federal Bail Reform Act of 1984.
Abstract
The manual is designed to provide a quick and clear reference to the relevant statutory language, legislative history, and appellate case law. After summarizing the provisions of the Bail Reform Act, the manual provides guidance for the initial appearance. Information covers who may conduct the bail hearing, the court's options, and advice on practice. A discussion of issues and procedures pertaining to temporary detention is followed by a review of the factors the court considers in the bail hearing. The factors include the nature of the offense, the weight of evidence, personal characteristics, dangerousness, and the source of collateral. Conditions of release are discussed, followed by a review of issues and procedures in pretrial detention. Other topics addressed in major sections of the manual are orders of release and detention, the review and appeal of orders of release and detention, failure to appear, crimes while on release, violations of release conditions, detention or release after adjudication of guilt, and material witnesses.
