Written by an Executive Assistant United States Attorney, this paper describes the role of Federal prosecutors and Federal agencies in prosecuting juvenile gang members and other juvenile delinquents under Federal laws.
Abstract
The FBI and other Federal agencies are assisting local law enforcement agencies in investigating gang activity and drug-related violence as part of a Federal effort to assist local agencies in targeting and Federally prosecuting violent criminals. Prosecution can be based on Federal drug laws, firearms laws, the Federal carjacking law, and the Racketeer Influenced and Corrupt Organization Act (RICO). Prosecutions under RICO and RICO-related statutes must be approved by the Criminal Division of the Department of Justice. If the youth is under age 18, prosecutors must be aware of the laws and procedures applicable to juveniles. Some juveniles can be transferred to adult criminal court. By asserting powerful Federal criminal laws and the efforts of Federal agencies in cooperation with State and local agencies, United States Attorneys can take a leadership role in prosecuting these dangerous youths.
