The various aspects of criminal proceedings are reviewed from their masculine ideological conceptualization to the possibility of a feminist perspective.
Abstract
The criminal process, including the purported dichotomy between substance and procedure, and the roles played by judges, counsel, and juries are examined from a feminist point of view. The conclusion indicates a need for women to rewrite the judicial process so that all persons, regardless of sex, are treated equally, and caring for all becomes the base for law rather than masculine-dominated ideology. 59 notes.
