This report of the 50th International Training Course on dispositional decisions summarizes discussions regarding decisions over initiation of the penal process and prosecution, sentencing, corrections, and coordination among criminal justice agencies in Asia.

Abstract

Regarding initiation of the penal process and prosecution topics considered are discretion in initiation of the penal process, discretion in initiation of prosecution, standards for the exercise of prosecutorial discretion. Sentencing discussions examine sentencing purposes, sentencing standards and factors to be considered in sentencing, sentencing alternatives, proper scope of sentencing discretion, and measures for ensuring rational and equitable sentencing (collection of relevant information, recommendation or participation by other agencies and persons concerned, establishment of standards and guidelines, training of judges, appellate review of sentences, etc.). In discussing decisions at correctional stages, issues considered are the major goals of corrections, the development of programs designed to achieve these goals, and factors to be considered in parole decisionmaking. Structures for coordination among criminal justice agencies are also considered. No references are supplied.
