THE WEST GERMAN DEPARTMENT OF JUSTICE PRESENTS THE PROCEEDINGS OF THE NINTH WORKSHOP OF THE EXPERT COMMISSION FOR THE REPRESSION OF ECONOMIC CRIME.
Abstract
DURING THE NINTH WORKSHOP (HELD APRIL 7-11, 1975, IN WESTERLAND/SYLT, WEST GERMANY), LEGAL AND ECONOMIC EXPERTS, REPRESENTATIVES OF PROFESSIONAL ASSOCIATIONS, AND HIGHRANKING GOVERNMENT OFFICIALS CONTINUED THEIR EARLIER DISCUSSION (EIGHTH WORKSHOP) ON THE REFORM OF COMPETITION AND ANTITRUST LEGISLATION. AFTER HEARING EXPERT REPORTS ON TOPICS LIKE 'HOW CAN CONSUMER ASSOCIATIONS BE STRENGTHENED?' OR 'IS ADDITIONAL CIVIL LEGISLATION REQUIRED?' THE COMMISSION FOCUSES ON THE FOLLOWING TOPICS: (1) CONSUMER CLAIMS FOR DAMAGES AND THE ANNULMENT OF CONTRACTS IN CASES OF UNFAIR COMPETITION (CIVIL LAW); (2) ADMINISTRATIVE LEGISLATION FOR IMPROVING CONSUMER PROTECTION; (3) CRIMINAL LEGISLATION FOR IMPROVING CONSUMER PROTECTION. THE SPECIFIC RECOMMENDATIONS OF THE TWO SUBCOMMITTEES (ONE CONCENTRATING ON CIVIL LAW, ONE ON CRIMINAL LAW) ARE SUMMARIZED; THEY INCLUDE SUCH AREAS AS THE ANNULMENT OF CONTRACTS, THE COLLECTIVE CLAIM TO DAMAGES BY CONSUMER ASSOCIATIONS, THE PRECEDENCE OF COLLECTIVE CLAIMS OVER INDIVIDUAL CLAIMS, AND DECEPTIVE ADVERTISING. THE OFFICIAL RECOMMENDATIONS OF THE PLENUM CONCERNING THE RIGHT TO CONTRACT ANNULMENT, CLAIMS FOR DAMAGES, AND CORRECTION OF DECEPTIVE ADVERTISING IN CIVIL AND CRIMINAL LAW ARE ALSO PRESENTED.
