This booklet guides laypersons in the processes and techniques involved in disputing tickets for minor traffic violations in the Washington State courts.
Abstract
It is usually futile to retain a lawyer for a minor traffic offense, but laypersons stand an excellent chance of receiving 'not guilty' verdicts if they take the time to dispute the matter. This guide is based on common practices observed as of 1976 in the metropolitan areas of Washington State. A copy of the motor vehicle code is also necessary in preparing a defense. Beginning with an overview of traffic laws, the book suggests procedures that should be followed when a driver is stopped by a police officer or involved in an accident. Backgound information on court processes precedes an explanation of how to prepare for a trial, including constitutional rights, researching the motor vehicle codes and relevant judicial decisions, and defense strategies. Rules of evidence and the actual trial are then discussed accompanied by sample cross-examinations of a police officer. Special defense tactics to counter tickets based on radar traps are detailed. Parking citations are briefly covered. Finally, sentencing and appeal procedures are considered, followed by a description of the responsibilities and practices of the Department of Motor Vehicles. Tables showing the progressive schedule for speeding violations, sections of the municipal traffic code, and Washington State surtax on moving violations are appended.
