FOUND NO STATISTICALLY SIGNIFICANT RELATIONSHIPS BETWEEN RECRUITMENT SYSTEMS AND THE SUCCESS OF DIFFERENT TYPES OF APPELLANTS IN STATE SUPREME COURTS.
Abstract
DATA WERE COLLECTED FROM EACH OF THE FIFTY STATES' COURTS OF LAST RESORT. INFORMATION WAS OBTAINED ON THE LITIGANTS INVOLVED IN EACH CASE LEADING TO THE ESTABLISHMENT OF 5 MAJOR CATEGORIES OF APPELLANTS - THE STATE, CRIMINAL DEFENDANT, CORPORATE AND BUSINESS LITIGANTS, SUPERIOR ECONOMIC LITIGANTS, AND INFERIOR ECONOMIC LITIGANTS. RESULTS OF DATA ANALYSIS APPARENTLY INDICATED THAT FORMAL JUDICIAL RECRUITMENT PROCESSES HAVE LITTLE IMPACT UPON THE KINDS OF DECISIONS MADE BY COURTS SELECTED UNDER EACH SYSTEM.
