Guidelines on the independence of the judiciary emphasize that justice requires that everyone be entitled to a fair and public hearing by a competent, independent, and impartial tribunal.
Abstract
The guidelines deal with the concepts of independence and impartiality and the principle of separation of judicial functions from other functions of the government. The guidelines also stipulate that judges have freedom of expression and association. Provisions discuss judicial qualifications, selection, and preservice and inservice training; promotion and transfer; and tenure. Other provisions discuss professional duties and immunity and deal with such issues as confidentiality for disqualification, discipline, and removal. The role of the judiciary in court management also is considered. The draft resolution is appended. 2 notes.
