In addition to a review of the implementation of existing standards and norms, this working paper considers safeguards with regard to capital punishment; addresses the adoption of new standards in the areas of the transfer and treatment of foreign prisoners, independence of the judiciary, and administration of juvenile justice; identifies areas of interest for new standards and norms, including the rights of prisoners; and examines the role and scope of international cooperation in promoting a more effective application of standards and norms.
Abstract
The effectiveness of United Nations standards and norms in criminal justice depends largely on the willingness of member states to accept and implement them. Full implementation could be realized by incorporating United Nations instruments into national legislation and practice by strengthening national recourse procedures. Measures to promote more effective implementation include adapting standards and norms to the requirements of economic and social development, facilitating community participation and informed public opinion, and creating an atmosphere of readiness towards the observance of the principles embodied in the standards and norms. 15 footnotes
