There is the fourth amendment of ringing, libertarian terms; and then there is the fourth amendment in action.
Abstract
As the title suggests, this is search and seizure in action and the action is not always pretty or libertarian. The material for this article was gathered when the author was employed by the National Center for State Courts and is a fascinating picture of prosecutors, police, and judges in the quest for evidence. Although the Center made the author's research possible, it is, of course, in no way responsible for the author's conclusions in this article. (Publisher abstract)
