Annotation

In four parts -- crime prevention, criminal proceedings, rehabilitation of the offender, and guaranteeing the rights of the victim -- this paper addresses crime prevention, corrections and protection of the offender, public participation, and the joint effort of the whole society in China.

Abstract

Although under the leadership of the government, crime prevention and crime control in China involve the whole society through the use of economic, administrative, legal, cultural, and educational means. The police network is decentralized, and local police stations are linked closely with local communities. Each local jurisdiction has a neighborhood committee that is responsible for maintaining public order. Activities and education designed to prevent criminal behavior are administered by these committees in cooperation with the public security agencies. The agencies of crime control emphasize moral education and strict control of cultural conditioning as means of preventing criminal behavior. There is strong control over the values, products, and activities marketed to youth. In discussing public participation in criminal proceedings, this paper addresses the mobilization of the public to control crime, openness and impartiality in the administration of justice, and the trial procedure for juvenile delinquents. In an overview of society's participation in the rehabilitation of offenders, the author considers social reintegration, offenders' relatives' participation in rehabilitation, and proper penalty methods for juvenile offenders. A section on aid to victims and victims' participation in criminal proceedings addresses the victim's right to prosecute, public prosecution, protection of the victim's procedural rights, the right to obtain legal remedy, and the victim's right to participate in the court hearing.
