SUGGESTIONS TO SPEED THE JUDICIAL PROCESS BY PROVIDING EXTRA-JUDICIAL PROCESSING OF SOME CLASSES OF MINOR OFFENSES, SIMPLIFYING THE JUDICIAL PROCESS FOR OTHER MINOR OFFENSES, AND RATIONALIZING THE JUDGE'S WORKLOAD.
Abstract
IT IS SUGGESTED THAT THE TRADITIONAL JUDICIAL PROCEDURE FOR MINOR OFFENSES (CITATION) BE RESERVED FOR CASES OF A CERTAIN GRAVITY. TWO SIMPLIFIED JUDICIAL PROCEDURES FOR THE LESS GRAVE OFFENSES ARE DESCRIBED. SINCE SIMPLIFICATION WOULD SACRIFICE SOME TRADITIONAL PROCEDURAL PRINCIPLES, SAFEGUARDS ARE NECESSARY TO PREVENT THE VIOLATION OF BASIC RIGHTS OF THE ACCUSED IN THE INTEREST OF EFFICIENCY. RATIONALIZATION OF THE JUDGE'S WORKLOAD WOULD INCLUDE SPECIALIZATION IN CASES INVOLVING FINANCIAL MATTERS. FURTHER SIMPLIFICATION WOULD INCLUDE THE ELIMINATION OF FORMALITIES WHICH DO NOT CORRESPOND TO THE REAL GUARANTEE OF RIGHTS TO THE ACCUSED. --IN FRENCH.
