PROVIDES A COMMENTARY ON THE DECISION AND SUBSEQUENT STATE REACTIONS, WITH SPECIFIC REFERENCE TO THAT OF GEORGIA.
Abstract
COMMENTS ARE MADE ON THE PERSONAL OPINIONS AND PRINCIPLES DEVELOPED BY EACH OF THE SUPREME COURT JUSTICES RULING ON THE DECISION. ATTENTION IS THEN GIVEN TO THE VARIOUS STATES AND EFFORTS OF THEIR LEGISLATIVE AND JUDICIAL BRANCHES TO INTERPRET THE DECISION IN TERMS OF ITS COMPATIBILITY WITH THEIR PRESENT LAWS. FOR EACH STATE IT IS LISTED WHETHER LEGISLATION WAS PASSED, A DECISION IS TO BE DECIDED BY REFERENDUM, THE DEATH PENALTY HAS BEEN REINSTATED FOR DEFINED MURDER, OR WHETHER THE DEATH PENALTY HAS BEEN REINSTATED FOR DEFINED MURDER AND FOR OFFENSES OTHER THAN MURDER.
