DISCUSSION OF THE CONFLICTING RIGHTS OF THE PRESS TO GATHER INFORMATION AND OF THE INDIVIDUAL TO A FAIR TRIAL BY AN IMPARTIAL JURY.
Abstract
EXAMINATION OF THE SUCCESSFUL PROTECTION OF FAIR TRIAL RIGHTS OF THE NEW YORK STATE COURT SYSTEM WITHOUT INFRINGING FIRST AMENDMENT RIGHTS OF THE PRESS IS UNDERTAKEN. THE USE OF CHANGE OF VENUR, VOIR DIRE, CONTINUANCE, MISTRIAL SEQUESTRATION, AND INSTRUCTION HAS PROVEN ADEQUATE AS AN ALTERNATIVE TO ISSUING A COURT ORDER PROHIBITING COUNSEL, POLICE, AND WITNESSES FROM DISCUSSING CERTAIN ASPECTS OF CASES WITH THE NEWS MEDIA.
