Abstract
DO GAG ORDERS ON THE PRESS ENSURE THAT A DEFENDANT WILL NOT HAVE A FAIR TRIAL? ACCORDING TO THE AUTHORS, THE ANSWER LEANS TOWARD THE AFFIRMATIVE. GAG ORDERS HOLD NO PROSPECT OF REDUCING PREJUDICE AMONG POTENTIAL JURORS, THE ARTICLE STATES. THEY ARE ALSO COSTLY, ESPECIALLY IN A POLITICAL CASE WHERE FAVORABLE MEDIA EXPOSURE COULD RESULT IN DONATIONS TO THE DEFENSE.
