REVIEW OF THE PRESENT NEW JERSEY GRAND JURY SYSTEM WITHIN ITS HISTORICAL PURPOSES AND EXAMINATION OF ALTERNATIVES WHICH EXIST IN OTHER JURISDICTIONS.
Abstract
THE HISTORICAL BACKGROUNDS OF GRAND JURIES IN BRITAIN, THE UNITED STATES, AND NEW JERSEY ARE ANALYZED. STATE LAWS CONCERNING MODES OF INITIATING CRIMINAL PROSECUTIONS FOR OFFENSES INDICTABLE UNDER NEW JERSEY LAW AND THE ROLE OF THE GRAND JURY IN INVESTIGATING OFFICIAL MISCONDUCT ARE SURVEYED. ADVERSARIAL ALTERNATIVES DISCUSSED INCLUDE THE CALIFORNIA MODEL, THE FEDERAL RULES OF CRIMINAL PROCEDURE, AND THE MODEL CODE OF PRE-ARRAIGNMENT PROCEDURE. THE RHODE ISLAND MODEL IS OFFERED AS AN EXAMPLE OF A NON-ADVERSARIAL ALTERNATIVE. THE INVESTIGATIVE FUNCTION OF THE GRAND JURY IS BRIEFLY REVIEWED. BRIEF DESCRIPTIONS OF THE GRAND JURY AND PRELIMINARY HEARINGS IN EACH STATE ARE CONTAINED IN APPENDIXES.
