This two-volume treatise is designed to provide prosecutors and representatives of grand jury targets or witnesses with a comprehensive description of grand jury law and practice in the State and Federal criminal justice systems.
Abstract
It also provides practical suggestions for handling the legal issues that relate to grand jury proceedings. A historical overview traces the development of the modern grand jury from its English origins to the modern era. The grand jury's role at the State and Federal levels is defined, with emphasis on requirements imposed by the fifth amendment, Federal laws and procedural rules, and State laws and regulations. Procedures related to grand jury reports, the selection and summoning of jurors, grand jury organization and administration, and subpoenas and indictments are detailed. Procedures to protect the secrecy of grand juries are also described. Additional chapters explain parallel civil and criminal proceedings, grants of immunity to grand jury witnesses, improper conduct by prosecutors, the use of the grand jury for improper purposes, and judicial review.
