After an introduction that describes the history, structure, and content of the Greek Penal Code, this book presents an English translation of the code.
Abstract
The introduction notes that as of its writing the Greek Criminal Code presented does not reflect present reality in the administration of criminal justice in Greece. This is due to the military overthrow of April, 1967 which abolished the democratic constitution under which the Criminal Code was forged and applied. The code presented became effective January 1, 1951. The General Part (Book One) contains eight chapters, with each chapter focusing on some aspect of general provisions of the penal law. Topics covered are the penal law; the offense; attempt and complicity; punishments, security measures, and restitution; computation of punishment; conditional suspension of sentence and parole; bars to punishability; and minors. The code's Special Part (Book Two) characterizes as offense those acts that strike at the root of State organization and which, by their nature, must be deemed offenses against the ordinary criminal law. The code classifies offenses according to their seriousness, namely, felonies, misdemeanors, and violations. The code is designed to provide full guarantees to the individual against any excesses of State authority in the administration of criminal justice. It further focuses on individual deterrence by adjusting the penal sanction to the offender's circumstances and personality. Book III contains transitional provisions.
