This manual is designed to assist States in monitoring compliance with three of the four core protections of the Juvenile Justice and Delinquency Prevention (JJDP) Act of 2002: the deinstitutionalization of status offenders, removal of juveniles from adult jails and lockups, and separating adult offenders from juveniles in institutions.
Section 1 of this guide provides background information on the four protections in the JJDP Act. The fourth protection, which is addressed in a separate guide, pertains to the reduction of the disproportionate confinement of minority youth. Section 2 addresses monitoring for compliance in removing juveniles from adult jails and lockups. It first addresses definitions related to adult jails and lockups as well as definitions of secure and nonsecure custody of juveniles held in adult jails and lockups. The section then focuses on compliance with the deinstitutionalization of status offenders. Guidelines in this area address the prohibition against the secure holding of status offenders, the exemption of the Youth Handgun Safety Act, and how to monitor for the deinstitutionalization of status offenders. This section also provides guidance for monitoring compliance with the removal of juveniles from adult jails and with the mandate to separate juveniles in custody from adult inmates. Facility reporting requirements are also discussed. Section 3 discusses the monitoring of JJDP Act protections for juveniles in juvenile facilities. Section 4 discusses monitoring for compliance with the JJDP Act in other facilities, such as court holding facilities, adult prisons, secure mental health treatment units, and nonsecure community-based programs and facilities. The remaining three sections address State monitoring of facilities, reporting requirements, and standards for demonstrating compliance. Ten appendixes provide supplementary information.
