This guide to the Interstate Compact on the Placement of Children examines why it is needed, what it does, procedures for placements under the compact, and penalties for illegal placements.
Abstract
The Interstate Compact on the Placement of Children is the best means available to ensure protection and services to children who are placed across State lines for foster care or adoption. Children placed out-of-state must be assured of the same protections and services that would be provided if they remained in their home States. They must also be assured of a return to their original jurisdictions should placement prove not to be in their best interests or should the need for out-of-state services cease. The Compact is a uniform law that has been enacted by all 50 States, the District of Columbia, and the U.S. Virgin Islands. It establishes orderly procedures for the interstate placement of children and fixes responsibilities for those involved in placing the child. The Compact law contains 10 articles. They define the types of placements and placers subject to the law; the procedures for making an interstate placement; and the protections, services, and requirements under the law.
