This guide reviews constitutional, statutory, and case law related to search and seizure that is of concern to New York law enforcement officers.
Abstract
The guide covers statutory laws of search and arrest warrants, arrest without warrants, and stop and frisk. In addition, the guide considers exceptions to search with warrants, such as administrative searches, the automobile exception, consent, inventory searches, open fields, plain view, and street encounters. Certain cases are discussed in some detail in order to provide examples of how some courts apply legal principles to everyday police situations. The guide is intended for use by supervisory, training, and field officers to increase the efficiency of law enforcement and minimize the risk of mistakes. To this end, five guide sections detail search warrants, law of arrest, probable cause, searches without warrants, and miscellaneous provisions of New York law related to search and seizure.
