This outline identifies significant developments in Federal appellate court decisions on the Federal Sentencing Guidelines and the 1984 Sentencing Reform Act, as amended, based largely on cases summarized in Guideline Sentencing Update.
Abstract
The outline includes court decisions up to December 31, 1994, and focuses on selected issues of interest to judges and others who use the Guidelines. Individual sections focus on general application principles, including relevant conduct, sentencing factors, incriminating statements as part of a cooperation agreement, amendments, commentary, policy statements, continuing offenses, and juvenile sentencing. Additional sections focus on focus on setting the offense level based on drug quantity, calculating the weight of drugs, possession of a weapon by a drug defendant, the calculation of the loss for specific property offenses, adjustments related to the victim and the offender, and the use of the criminal history. Further sections focus on the determination of the sentence, upward and downward departures from the guidelines, violation of probation and supervised release, the sentencing of organizations, sentencing procedures, and appellate review.
