THIS MONOGRAPH DISCUSSES COURT MANAGEMENT CONCEPTS AND INNOVATIVE FACILITY PLANNING IDEAS FOR THE STATEWIDE COURT PLANNING LEVEL.
Abstract
IN THE FIRST SECTION, THE SUBJECT OF STATE COURT STRUCTURE, EMBRACING THE TYPES OF COURTS AND ADMINISTRATIVE RELATIONSHIPS A STATE HAS ADOPTED OR CHOOSES TO ADOPT, IS PRESENTED. UNIFICATION OF THE APPELLATE AND TRIAL COURT STRUCTURE IS EVALUATED, TOGETHER WITH SOME OF THE CHARACTERISTIC FEATURES WHICH UNIFICATION WOULD IMPLY FOR THE OPERATION OF THE COURTS. THE NEXT SECTION ADDRESSES THE ABSTRACT BUT IMPORTANT PROBLEM OF ORGANIZING A STATE INTO JUDICIAL DISTRICTS. THE THREE SECTIONS ANALYZE THE THREE MAJOR BRANCHES OF A STATE JUDICIAL SYSTEM: THE COURT OF LAST RESORT, INTERMEDIATE APPELLATE COURTS, AND TRIAL COURTS OF GENERAL JURISDICTION. THE FINAL SECTION THEN SUMMARIZES THE DISCUSSION ON JURISDICTIONS BY EXAMINING THE PROBLEMS OF RATIONALLY DISTRIBUTING AND LOCATING FACILITIES WITHIN THE STATE.
