IN THIS EDITORIAL STATEMENT, SEVERAL GUN CONTROL ISSUES ARE DISCUSSED, AND AN ALTERNATIVE TO GUN CONTROL - THE USE OF AN ADDITIONAL MANDATORY SENTENCE WHENEVER A LETHAL WEAPON IS USED - IS PROPOSED.
Abstract
AMONG THE ISSUES DISCUSSED IN THIS ARTICLE ARE THE RIGHT TO BEAR ARMS PROVIDED IN THE SECOND AMENDMENT TO THE U.S. CONSTITUTION, THE REASONS CITIZENS MAY WISH TO KEEP FIREARMS, THE RELATIONSHIP OF FIREARM POSSESSION TO CRIME, THE REGULATION OF SATURDAY NIGHT SPECIALS' AND THE RESULTS OF NEW YORK'S STRICT GUN CONTROL LAW. THE AUTHOR ARGUES THAT THE SECOND AMENDMENT DOES IN FACT CONFER THE RIGHT TO BEAR ARMS ON ALL CITIZENS. IT IS ALSO ARGUED THAT GUN CONTROL LEGISLATION WOULD AFFECT ONLY LAW-ABIDING CITIZENS, AND THAT THE NEW YORK EXPERIENCE WITH GUN CONTROL HAS DEMONSTRATED THAT SUCH PROGRAMS ARE NOT EFFECTIVE.
