THIS ARTICLE SEEKS TO EXPLAIN WHY THE WARREN COURT EXPANDED THE WRIT OF HABEAS CORPUS AS IT DID AND WHAT GOALS WERE SERVED.
Abstract
IN ADDITION, THE ARTICLE EXAMINES THE BURGER COURT'S ACTIONS IN THIS AREA AND REVIEWS THE SUBSTANTIAL CHANGES MADE IN THE WRIT OF HABEAS CORPUS BY THAT COURT. THE PRESENT COURT'S RETREAT FROM THE WARREN COURT EXPANSION OF THE WRIT AND ITS CONCOMITANT RETREAT FROM THE DUE PROCESS REVOLUTION OF THE 1960'S ARE ALSO REVIEWED. (AUTHOR ABSTRACT MODIFIED)
