STANDARDS AND GOALS FOR IMPROVING THE CRIMINAL JUSTICE SYSTEM IN HAWAII, SPECIFICALLY THE COURTS, ARE PRESENTED; MODEL STANDARDS DEVELOPED BY NATIONAL ORGANIZATIONS WERE REVIEWED FOR REJECTION OR ADOPTION.
Abstract
COMPREHENSIVE INTERRELATED STANDARDS ARE PRESENTED, AS DEVELOPED BY THE STATE LAW ENFORCEMENT AND JUVENILE DELINQUENCY PLANNING AGENCY, FOR IMPROVEMENT OF COURT EFFICIENCY. THESE STANDARDS ARE DIVIDED INTO THE FOLLOWING MAJOR SUBJECT AREAS: (1) SCREENING STANDARDS THAT INVOLVE CRITERIA AND PROCEDURES FOR THE SCREENING PROCESS, (2) DIVERSION STANDARDS THAT ALSO INCLUDE CRITERIA AND PROCEDURE GUIDELINES, (3) THE NEGOTIATED GUILTY PLEA SECTION THAT INCLUDES PLEA NEGOTIATIONS AND REPRESENTATION BY COUNSEL, AND (4) THE LITIGATED CASE WHICH ENCOMPASSES PROCEDURE FOR MISDEMEANOR PROSECUTIONS, PRETRIAL RELEASE, CONTINUANCES, AND JURY SELECTION STANDARDS. NEXT, THE COURT'S ROLE IN SENTENCING IS DISCUSSED, FOLLOWED BY A REVIEW OF TRIAL COURT PROCEEDINGS DESCRIBING UNIFIED AND FLEXIBLE REVIEW PROCEEDINGS, AND PROCEDURES FOR FURTHER REVIEW. ALSO COVERED ARE STANDARDS RELATING TO JUDICIAL SELECTION, TENURE, COMPENSATION, DISCIPLINE AND REMOVAL, AND EDUCATION. A DISCUSSION CONCERNING LOWER COURT STANDARDS RELATING TO UNIFICATION OF THE STATE COURT SYSTEM AND DISPOSITION OF PARTICULAR MATTERS NOW TREATED AS CRIMINAL OFFENSES FOLLOWS, SUCCEEDED BY TOPICS IN COURT ADMINISTRATION, SUCH AS CASEFLOW MANAGEMENT. FINALLY, COURT-COMMUNITY RELATIONS GOALS ARE DEVELOPED AND BOTH PROSECUTORIAL AND DEFENSE STANDARDS AND GOALS ARE DEFINED. (LWM)
