THE STUDY CONCENTRATES ON SYSTEM-ORIENTED ISSUES, SUCH AS THE SIZE OF JURIES, AND MANAGEMENT-ORIENTED ISSUES, SUCH AS THE SUMMONING AND QUALIFICATION OF JURORS.
Abstract
THE STUDY INCLUDES AN OVERVIEW OF THE PRESENT TRIAL JURY SYSTEM, INCLUDING THE NUMBER AND COST OF JURY TRIALS, THE LEGAL FRAMEWORK FOR AND PRACTICES OF THE JURY COMMISSIONS AND FINDINGS REGARDING THE LENGTH OF JURY TRIALS AND UTILIZATION OF JURORS. THE FOCUS OF THE REPORT IS ON 30 RECOMMENDATIONS, DISCUSSED UNDER MANAGEMENT-ORIENTED AND SYSTEM-ORIENTED SECTIONS. THE STUDY CONCLUDES WITH SUGGESTIONS OF PRIORITIES FOR IMPLEMENTING THE RECOMMENDATIONS AND INDICATES WHETHER STATUTORY, RULE, OR ADMINISTRATIVE CHANGES WOULD BE REQUIRED. THERE ARE FOUR APPENDICES. THE FIRST CONTAINS A SERIES OF TABLES WHICH PROVIDE THE DETAILED DATA SUPPORTING DISCUSSIONS IN THE TEXT. THE SECOND CONTAINS DATA AND AN ANALYSIS OF THAT DATA RELEVANT TO CIVIL JURY TRIALS IN THE FIRST CIRCUIT COURT FROM SEPTEMBER THROUGH DECEMBER 1974. THE THIRD CONTAINS RELEVANT FORMS USED BY THE VARIOUS CIRCUIT COURTS. THE JUROR UTILIZATION FORM AND QUESTIONNAIRE DISTRIBUTED TO JURORS IN THE SPRING OF 1975 ARE REPRODUCED IN THE FOURTH APPENDIX, ALONG WITH A SUMMARY OF JUROR RESPONSES TO THE QUESTIONNAIRE AND AN ANALYSIS OF THOSE RESPONSES....RCB
