This book is a practical guide to the defense of a criminal case, covering procedures through each stage of the investigation, trial, and appeal.
Abstract
The text is supplemented by sample pretrial motion forms with discussion, excerpts of trial transcripts, anecdotes of great defense lawyers, a sample brief, a sentencing memorandum, summary checklists for easy reference, and numerous suggestions on how to gain advantage over the prosecution. Special features include suggested voir-dire questions and an explanation of their importance, references to the Federal Rules of Criminal Procedure, and a discussion of fees. The book addresses the importance of effective cross-examination, underuse of the opening statement, crucial aspects of the final argument, and successful plea bargaining. It covers proper jury selection and appeal tactics and discusses direct examination of witnesses and witness preparation. Differences in strategy and practice between jury trials of serious felonies and lower court trials are detailed, as are sentencing considerations. The text identifies circumstances under which attorneys should encourage clients to take lie detector tests and mentions practical aspects of representing indigent defendants. Footnotes, an index, and checklists are provided. (Author summary modified)
