This report describes the current and proposed procedures used to comply with the Federal requirement that criminal justice records identify aliens who are convicted and provide that information to the Immigration and Naturalization Service (INS).
Abstract
The Federal mandate is part of the Immigration Act of 1990, which changed Section 503 of the Omnibus Crime Control and Safe Streets Act. States are required to have a coordination plan with INS as a condition for continuing to receive Edward Byrne Memorial State and Local Law Enforcement Assistance Formula Grants. Texas received $27 million of these funds in Federal fiscal year 1992. The initiative to improve records will help State and local governments reduce recidivism and probation supervision by deporting criminally involved aliens upon release from prison. Texas has been working to improve the quality of its criminal history records since 1987 and is developing its criminal justice information system, a statewide electronic reporting system. The overall goal is to provide INS with an electronic notification, from which INS can begin its verification and processing of the offender. Figure and form
