RECENT U.S. SUPREME COURT DECISIONS HOLD THAT 'USE IMMUNITY', WHICH PERMITS PROSECUTION FOR CRIMES TESTIFIED TO IF INDEPENDENT EVIDENCE IS USED, WITH THE FIFTH AMENDMENTS PRIVILEGE AGAINST SELF-INCRIMINATION.
Abstract
WITNESSES NOW CAN BE COMPELLED TO TESTIFY UNDER IMMUNITY AND ANY CRIMES THEY TESTIFY TO CAN BE PROSECUTED PROVIDED THAT THE PROSECUTION DEMONSTRATES THAT ITS EVIDENCE WAS NOT OBTAINED THROUGH THE USE OF IMMUNIZED TESTIMONY. THE NOTION OF TAINTED EVIDENCE IS DISCUSSED WITH REGARD TO NEW JERSEY PRACTICE.
