THE POSSIBLE EFFECTS OF THE ARGERSINGER V. HAMLIN RULING ON THE RESOURCES OF THE NEW MEXICO DISTRICT, MAGISTRATE, AND MUNICIPAL COURTS.
Abstract
SUGGESTED MEASURES FOR PROVIDING COUNSEL FOR INDIGENT MISDEMEANANT DEFENDANTS ARE DESCRIBED. MEASURES THAT COULD BE IMPLEMENTED TO LESSEN THE IMPACT ON THE COURT SYSTEM ARE PRESENTED, INCLUDING WAIVING THE RIGHT TO COUNSEL, ESTABLISHING STRICTER STANDARDS FOR DETERMINING INDIGENCY, AND PROVIDING PENALTIES OTHER THAN IMPRISONMENT. THE REPORT WAS PREPARED BY THE CRIMINAL JUSTICE PROGRAM STAFF UNDER ITS INTERNAL RESEARCH PROGRAM IN CONJUNCTION WITH ITS DESIGNATION BY LEAA AS THE INDEPENDENT RESEARCH TEAM ASSOCIATED WITH THE PILOT CITIES PROGRAM IN ALBUQUERQUE/BERNALILLO COUNTY.
