PLEA FOR A PRACTICAL SENTENCING MANUAL TO BE PREPARED BY A PERMANENT WORK GROUP WHICH WOULD ESTABLISH MODEL CASES WITH MATCHING SENTENCES ON THE BASIS OF FACTORS WHICH CUSTOMARILY INFLUENCE SENTENCING.
Abstract
A LARGE PERCENTAGE OF THE ORDINARY CASES THAT ARE TRIED WOULD BE FOUND TO BE COMPARABLE WITH ONE OF THE MODEL CASES IN THE MANUAL. THE AUTHOR FORESEES THE WORK GROUP AS CONSISTING OF TWO JUDGES, TWO PUBLIC PROSECUTORS, ONE LAWYER, A REHABILITATION OFFICIAL, A SOCIOLOGIST, A PSYCHOLOGIST, A PSYCHIATRIST, A PROFESSOR OF CRIMINAL LAW AND PERHAPS A PROFESSOR OF CRIMINOLOGY, PERHAPS SOMEONE FROM CORRECTIONS, AND THREE OFFICIALS FROM THE MINISTRY OF JUSTICE, WHICH WOULD ALSO PROVIDE A SECRETARY. THE MANUAL WOULD SERVE AS A SENTENCING GUIDE FOR JUDGES AND WOULD MAKE FOR MORE UNIFORMITY IN SENTENCING WHILE STILL LEAVING SENTENCING DISCRETION TO JUDGES. --IN DUTCH
