DISCUSSION OF THE CLASH BETWEEN ADVOCATES OF JUDICIAL INDEPENDENCE AND JUDICIAL ACCOUNTABILITY CAUSED BY THE CALIFORNIA DECISION TO IMPLEMENT COMPUTERIZED DATA COLLECTION FOR THE ENTIRE CRIMINAL JUSTICE SYSTEM.
Abstract
THE EMERGENCE OF THE OBTS (OFFENDER-BASED TRANSACTION STATISTICS) SYSTEM AND THE SOURCE OF THE CONFLICT IN THE LAW GOVERNING IT ARE EXAMINED. THE EFFECTS OF THE LAW ON THE JUDGES ROLE AND POSSIBLE MISUSE OF INFORMATION TO EFFECT RE-ELECTION OF JUDGES ARE ALSO DISCUSSED. COURT OBSERVATION AND PROFESSIONAL MONITORING BY THE BAR ARE SUGGESTED AS POSSIBLE ALTERNATIVE METHODS FOR OBTAINING DATA ON THE COURT SYSTEM WITHOUT STATISTICAL ANALYSIS.
