Jury instructions drafted for use under the new Indiana Penal Code pertain to such areas as preliminary remarks, general offenses, offenses against persons and property, other offenses, controlled subtances, basis of liability, standards of proof, evidence, and verdicts.
Abstract
The instructions are designed to inform jury members of their duties and responsibilities and to educate them in what they need to know to reach a decision in a particular case. Definitions based on the Indiana Penal Code are given for murder, manslaughter, kidnapping, and other offenses against the person. Arson, burglary, forgery, fraud, and other offenses against property are explained. Also defined are offenses against public administration; offenses against public health, order, and decency; miscellaneous offenses such as bigamy and incest; and crimes relating to firearms and explosives. Dealing in controlled drugs and possessing such items are explained. Defenses relating to culpability, types of evidence, general instructions to a jury, and definitions for various terms are included. The habitual offender and types of verdicts are also defined. Footnotes are provided.
