These annotated Indiana statutes pertinent to information privacy and security are intended to accompany the publication, "Compendium of State Privacy and Security Legislation: 1994 Overview."
Abstract
Legislation pertinent to criminal intelligence information contains provisions on the prohibition of any reference to an intelligence file in a criminal history file; grounds required for collecting and keeping information; the review of the retention of a file; and the prohibition on collecting political, religious, or social information. Other sections pertain to confidential information and sanctions for the unauthorized release of information. Other legislation focuses on criminal history information and procedures that govern the management and dissemination of such information. Legislation that addresses access to public records features provisions on the right of inspection of public records, time limitation on the confidentiality of records, the availability of information on where a person is arrested or jailed, records that contain disclosable and nondisclosable information, the protection of records, and action to compel the inspection or copying of a record. Other legislative provisions deal with the Criminal Justice Data Division, fair information practices, and the expungement of arrest records.
