THIS PAPER IS AN ATTEMPT TO DEVELOP A CONCEPTUAL FRAMEWORK FROM WHICH TO EXPLAIN AND PREDICT JUDICIAL SENTENCING DISPARITIES.
Abstract
IT DRAWS UPON THE CONTEMPORARY THEORETICAL PERSPECTIVE OF THE INTERACTIONIST/LABELING SCHOOL IN SUGGESTING THE ROLE OF SOCIETAL REACTION IN THE CREATION OF POSITIVE OR NEGATIVE IMAGES ABOUT AN ACTOR IN A SENTENCING SITUATION. THREE PROPOSITIONS SPECIFYING THE RELATIONSHIP BETWEEN AN ACTOR'S INDIVIDUAL RESOURCES AND THE SENTENCE HE OR SHE RECEIVES ARE PRESENTED.
