The Supreme Court now has given its unambiguous imprimatur to the inevitable discovery exception to the exclusionary rule. It has left open the question of the proper scope of federal have as proceedings in similar settings.
Abstract
The author, who represented the petitioner before the Supreme Court, reviews the development of the inevitable discovery rule and proposes a workable framework for its future application. The main premise here is that the doctrine safely may be applied where it is not used as a bootstrap by police to advance an investigation in a way not otherwise legally permissible.
