This paper is meant to analyze some of the consistently controversial issues surrounding the question of punishment, and more importantly, the decision as to whether the threat of certain punishment may deter future would-be violators.
Abstract
Philosophical, legal, and societal justifications for reparation are discussed with emphasis on a need for re-examining the current policies in our criminal justice system in its criteria for determining whether or not to impose punishment. (Publisher abstract)
