REGULATIONS PERTAINING TO INMATE CONDUCT AND THE PROCEDURES FOR THE ADMINISTRATION OF THE DISCIPLINE PROGRAM AT THE ARIZONA STATE PRISON ARE PRESENTED.
Abstract
VARIOUS FORMS OF DISPOSITION OF VIOLATIONS ARE EMPLOYED. VIOLATIONS WHICH CONSTITUTE MINOR INFRACTIONS MAY, AT THE DISCRETION OF THE PRISON STAFF, BE RESOLVED INFORMALLY BY COUNSELING, WARNING, OR ADMONISHING THE PRISONER. IF THE VIOLATION IS OF A SERIOUS NATURE, IT IS HANDLED IN A FORMAL MANNER AND THE FOLLOWING PROCEDURES ARE FOLLOWED: (1) THE STAFF MUST WRITE, SIGN, AND SUBMIT TO THE ASSOCIATE WARDEN A PRELIMINARY REPORT OF A VIOLATION GIVING THE TIME, PLACE, AND NATURE OF THE VIOLATION; (2) AT THE TIME OF THE INFRACTION THE STAFF MAY RESTRICT THE PRISONER TO THE CELL OR RELEASE HIM OR HER FROM A WORK OR TRAINING ASSIGNMENT; (3) UPON RECEIVING THE PRELIMINARY REPORT THE ASSOCIATE WARDEN WILL, IF NECESSARY, CONDUCT AN INVESTIGATION AND MAKE AN APPROPRIATE RECOMMENDATION REGARDING DISCIPLINARY ACTION; (4) IF THE ASSOCIATE WARDEN REFERS THE VIOLATION TO THE DISCIPLINARY COMMITTEE, HE OR SHE MUST IMMEDIATELY INSTITUTE AN INVESTIGATION TO DETERMINE THE FACTS AND CIRCUMSTANCES OF THE INCIDENT AND PREPARE AND FORWARD FORMAL DISCIPLINARY CHARGES; (5) IF THE ACCUSED IS NOT CONFINED IN LOCKUP STATUS PENDING THE HEARING BEFORE THE DISCIPLINARY COMMITTEE, HE SHALL BE PROVIDED A COPY OF THE FORMAL CHARGES WITHIN 5 WORKING DAYS; (6) IF THE ACCUSED IS CONFINED IN LOCKUP STATUS HE SHALL BE GRANTED A HEARING BEFORE THE COMMITTEE WITHIN 5 WORKING DAYS; (7) UPON SHOWING GOOD CAUSE THE ASSOCIATE WARDEN OR THE ACCUSED MAY BE GRANTED UP TO TWO CONTINUANCES; AND (8) IN NO EVENT WILL THE PLACING OF THE ACCUSED IN LOCKUP STATUS PENDING A HEARING OR DURING A CONTINUANCE AFFECT HIS EARNING TWO-FOR-ONE TIME, PROVIDED HE IS IN A TWO-FOR-ONE POSITION AT THE TIME OF THE LOCKUP. THE MAKEUP OF THE DISCIPLINE COMMITTEE IS OUTLINED AND THE CONDUCT OF DISCIPLINARY HEARINGS IS REVIEWED. THE DECISIONS AND ACTIONS REQUIRED OF THE COMMITTEE ARE DISCUSSED, AND THE SANCTIONS AND PENALTIES, AS WELL AS THE USE OF DISCIPLINARY ISOLATION, ARE EXAMINED. THE RULES AND REGULATIONS GOVERNING INMATE CONDUCT ARE PRESENTED. THESE INCLUDE VIOLATIONS AGAINST PERSONS AND VIOLATIONS PERTAINING TO THE SECURITY AND THE ORDERLY OPERATION OF THE PRISON; THE POSSESSION, MANUFACTURE, AND INTRODUCTION OF CONTRABAND; PROPERTY AND INVOLVING FRAUD; POLICY AND PROCEDURES; PERSONAL APPEARANCE AND SANITATION; AND VIOLATIONS PERTAINING TO SAFETY.
