This article offers practical risk management strategies for preventing institutional child sexual abuse and reducing the likelihood of malpractice and negligence lawsuits against child care agencies.
Abstract
Several pitfalls of litigation are identified, and sensible ideas for selecting attorneys and analyzing insurance coverage are presented. The ideas focus on screening and hiring practices, treatment program policies and practices, staff supervision and training, documentation and recordkeeping, and legal collaboration. The author recommends that all child care agencies institute policies explicitly prohibiting sexual contact between staff and clients and that individuals who fail to report known or suspected child abuse incidents be discharged and prosecuted. 11 references and 5 notes
