This chapter addresses computer crime in Poland as the result of social transformations generated by post-industrial information processing technologies.
Abstract
Focusing on computer crime in Poland as the result of social transformations generated as the result of post-industrial information processing technologies this chapter introduces computer crime offenses as falling into one of three categories including violating the confidentiality, integrity, or availability of data and computer-system security; violating property rights or the credibility of documentation; and transmitting prohibited materials through the Internet, and discusses Chapter 33 of the Polish Penal Code of 1997, entitled “Offences Against the Protection of Information.” Arguing that computer crimes are a relatively new phenomenon in Poland, the author describes changes in Polish criminal law, as of September 1, 1998, that allow for the prosecution of perpetrators of classic violations of electronic data security. Focusing on the nature and the extent of computer crimes in Poland, the author describes the only computer crimes victimization survey conducted in Poland in 1994, the notifications of criminal incidents reported to the Polish Telecom Statistics organization since 1997, and the security infringements reported to the Computer Emergency Response Team Research and Academic Network since 1996. The author concludes that international cooperation is necessary for the prankster and youthful nature of Internet related crime to be kept from increasing.
