The Interstate Compact on the Placement of Children (ICPC) was implemented in 1960 to ensure that children placed in out-of-state foster homes or adoptions would receive the same protections and services to which they would be entitled in their home States.
Abstract
However, despite its good intentions, controversy remains over conflicting interpretations and applications of the ICPC. Some of these disputes center over regulations including the parents within the compact, delaying investigations, and failing to provide any mechanism for temporary visitation rights pending acceptance. The author notes three primary goals for the ICPC. The first is to establish procedures to enable the juvenile court in the sending State to place a child with a parent in another State without ICPC approval when the court cannot find detriment. The second goal would be to establish firm time limits for the completion of parental investigations; other remedies would be required when recommended time limits were exceeded. The final objective would be to establish provisions for temporary visitation when it would serve the child's best interests. 26 notes
