THIS TEXT IS DESIGNED TO PROVIDE POSTSECONDARY STUDENTS OF CRIMINAL JUSTICE, CRIMINOLOGY, AND CRIMINAL LAW WITH A DESCRIPTION OF THE MAJOR COMPONENTS OF THE CRIMINAL JUSTICE SYSTEM.
Abstract
THE FRAMEWORK OF CRIME IN AMERICA IS DETAILED BY EXAMINING CRIME DEFINITIONS, CRIME TRENDS, CRIME CAUSATION, PRINCIPLE THEORIES IN CRIMINOLOGY, AND CRIMINAL LAW. AN OVERVIEW OF THE CRIMINAL JUSTICE SYSTEM DISCUSSES COMPONENTS, GOALS, AND ISSUES OF CRIMINAL JUSTICE, AS WELL AS THE CRIMINAL JUSTICE PROCESS. THE CONSTITUTIONAL RIGHTS OF THE ACCUSED ARE NOTED IN TERMS OF THE BILL OF RIGHTS, THE 14TH AMENDMENT, DUE PROCESS OF LAW, AND THE EXCLUSIONARY RULE. TYPES OF CRIMINAL JUSTICE MODELS DESCRIBED INCLUDE SYSTEMS, PROCESS, ORGANIZATIONAL, AND MANAGERIAL MODELS. A SECTION ON LAW ENFORCEMENT PROVIDES A SURVEY OF THE POLICE IN SOCIETY, INCLUDING THE HISTORY, ORGANIZATION, AND BEHAVIOR OF POLICE; THE POLICE PROCESS IS TREATED IN RELATION TO CRIME DETECTION, INVESTIGATION, SEARCH AND SEIZURE, WARRANTLESS SEARCHES, ARREST, CUSTODIAL INTERROGATION, AND THE LINEUP. THE ROLE OF THE PROSECUTOR, PROSECUTORIAL DISCRETION, ALTERNATIVES TO PROSECUTION, THE CRIMINAL DEFENSE ATTORNEY'S ROLE, THE LAWYER AS PROFESSIONAL ADVOCATE, THE RIGHT TO COUNSEL, AND PUBLIC DEFENDER SERVICES ARE AMONG THE TOPICS IN A CHAPTER ON THE PROSECUTION AND THE DEFENSE. PRETRIAL PROCEDURES, ENCOMPASSING POST ARREST PROCEDURES, BAIL, PRETRIAL DETENTION, THE GRAND JURY, PRELIMINARY HEARINGS, ARRAIGNMENT, THE PLEA-BARGINING, AND PRETRIAL DIVERSION, ARE ALSO DESCRIBED. THE JUDICIAL PROCESS IS DISCUSSED FROM THE PERSPECTIVE OF THE COURTS, THE CRIMINAL TRIAL, SENTENCING, AND PROBATION. AN OVERVIEW OF CORRECTIONAL HISTORY AND INSTITUTIONS INCLUDES THE CORRECTIONAL POPULATION, JAILS, CLOSED INSTITUTIONS, COMMUNITY CORRECTIONS, AND CLASSIFICATION SYSTEMS FOR OFFENDERS. A MORE IN-DEPTH LOOK AT INSTITUTIONAL LIFE DEALS WITH PHYSICAL CONDITIONS IN PRISONS, A PROFILE OF MEN IN PRISON, MALE INMATES' ADJUSTMENT TO PRISON, THE SOCIAL CODE OF THE MALE INMATE, TREATMENT OF MALE INMATES WITHIN THE INSTITUTIONS, WOMEN IN PRISON, AND PRISON RULES AND DISCIPLINE. THE CONCEPT, HISTORY, AND EFFECTIVENESS OF PAROLE ARE DISCUSSED, AS ARE PAROLE BOARDS, HEARINGS, DISCRETION, PREDICTION TABLES, RULES, SUPERVISION, AND REVOCATION.
