GENERAL TREATISE BY THE DEAN OF THE FACULTY OF LAW OF THE UNIVERSITY OF TOKYO, INCLUDING HISTORICAL DEVELOPMENT, BASIC CONCEPTS, STRUCTURE OF COURTS, PROSECUTION, AND DEFENSE AND RULES OF INVESTIGATION, EVIDENCE, AND APPEAL.
Abstract
JAPANESE LAW OF CRIMINAL PROCEDURE IS A BLENDING OF ORIENTAL, CONTINENTAL EUROPEAN, AND ANGLO-AMERICAN LAW TO FORM A UNIQUE SYSTEM. ANGLO-AMERICAN LAW HAD A STRONG INFLUENCE AFTER WORLD WAR II AND HAS OFFERED A PRACTICAL DEMONSTRATION OF THE DEGREE TO WHICH CONTINENTAL EUROPEAN AND ANGLO-AMERICAN LEGAL SYSTEMS CAN BE COMBINED. THIS UNIQUE BLENDING TOGETHER OF DIFFERENT LEGAL SYSTEMS INCLUDES NOT ONLY THE JAPANESE CODE OF CRIMINAL PROCEDURE ITSELF BUT ALSO JAPANESE SCHOLARSHIP IN THE FIELD. THIS IS THE FIRST TEXTBOOK IN THE ENGLISH LANGUAGE ON ANY FOREIGN SYSTEM OF CRIMINAL PROCEDURE AND IS OFFERED AS MATERIAL FOR COMPARATIVE STUDY OF NATIONAL LEGAL SYSTEMS. APPENDED ARE THE TRANSCRIPTS OF TWO JAPANESE CRIMINAL CASES. (AUTHOR ABSTRACT MODIFIED)
