THE MEMBERS OF THE JURY ARE AS MUCH A PART OF THE CRIMINAL JUSTICE SYSTEM AS ARE JUDGES, ATTORNEYS OR THE ARREST AND CORRECTIONAL SYSTEMS. THIS 1978 REPORT STUDIES JURY USE.
Abstract
A SUMMARY OF THE USE OF INDIVIDUALS SUMMONED FOR JURY DUTY IS PRESENTED IN THIS GENERALLY STATISTICAL REPORT. THE INFORMATION IS TAKEN FROM COURT RECORDS FROM JULY AND AUGUST 1978. THE REPORT INCLUDES A LONG APPENDIX SECTION, INCLUDING THE APPROPRIATE SECTIONS FROM THE KENTUCKY CRIMINAL CODE ON COURT MANAGEMENT AND JURY SELECTION. APPROPRIATE FORMS RELATING TO SERVICE ON A JURY ARE ALSO PRESENTED. NO OVERALL CONCLUSION SECTION IS PRESENTED, BUT COMMENTARY IS ADDED IN DISCUSSIONS OF EACH SECTION OF THE COURT AND JURY SYSTEM AND SELECTION PROCESS. THERE APPEAR TO BE CERTAIN PROBLEMS WITH THE EFFECTIVE OPERATION OF THE SYSTEM, NOT UNIQUE TO THE PARTICULAR COURT SYSTEM. A PARTICULAR CASE IS THE USE OF JURORS AS ACTUAL PANEL IN ONLY A LITTLE OVER ONE QUARTER OF THE TIME. A CASE IN WHICH AN APPARENT PROBLEM WAS FOUND NOT TO EXIST WAS IN THE NUMBER OF MEN AND WOMEN SUMMONED. THE NUMBERS FOR BOTH WERE FOUND TO BE APPROXIMATELY EQUAL. THE REPORT CONTAINS, CHARTS, TABLES AND A LONG APPENDIX SECTION. (KCP)
